Use of this website, purchases made through it, and acquisitions made by direct correspondence are subject to the following.

TERMS

1. Listings and condition
Each piece is one of one.
Once sold, a listing is removed from active stock.

Objects are presented with their age intact. Patina, wear, repair history, and prior use are part of the work and are not faults.
Images, specifications and notes on the product page form part of the description.

Where attribution is verified, it is stated.
Where attribution is uncertain, possibilities are noted and the record is left open.
No warranty of attribution is given on a possibility-noted listing. Buyers should satisfy themselves before purchase and are welcome to ask.

Variations in colour, tone, grain, and texture may occur between screen and object.

Electrical items.
Where a vintage lighting item or other electrical product has been rewired or serviced by KOBK before listing, the work is carried out for domestic use, and the item is test-and-tag certified by a licensed electrician. Records are kept per item. Any modification of the item by the buyer after delivery is at the buyer's risk.

2. Availability and order acceptance
All works are subject to availability and may be withdrawn at any time before order acceptance.
A completed checkout is an offer to purchase.
Order acceptance occurs at dispatch. If a piece is sold or withdrawn before acceptance, the order is cancelled and any payment refunded in full.

3. Pricing and payment
Prices are listed in Australian Dollars (AUD).
KOBK Pty Ltd is not registered for GST at this stage. GST is not charged on orders.
Errors in pricing may be corrected before order acceptance.
Payments are processed by Shopify and its third-party providers. KOBK does not store full payment card details.

4. Off-catalogue acquisitions
Requests for pieces not currently listed may be made by email.
A written quote is required before any acquisition is binding.
No guarantee of sourcing is given. KOBK will respond with what is reasonably available.

5. Shipping
Orders are dispatched from Footscray, Victoria.
Shipping is priced or quoted in Australian Dollars. Where it is priced you see the figure at checkout. Where it is quoted you see the figure before anything is dispatched, and nothing is dispatched until you have agreed it.

Small parcels ship at a flat rate by weight, tracked and insured, and free over $150 within Australia. That threshold applies to small parcels only. It does not apply to larger or fragile objects, to furniture, or to anything going overseas.

Larger or fragile objects ship at a flat rate that reflects their packed size as well as their weight, and are not included in the free-shipping threshold. Carriers price a parcel on the greater of its actual weight and its cubic weight, which is why a light but bulky object costs more to send than a heavy small one. Both are dispatched as soon as the piece is packed and a carrier slot allows.

Furniture freight is never charged at checkout, Melbourne included. Delivery shows as $0 on furniture wherever you are, because Shopify prices by state and cannot split Victoria, so nothing is collected on the way out. On every furniture object page there is a delivery check: enter a Melbourne postcode and it gives you the figure for that piece to a Melbourne address. That figure is invoiced separately and agreed before the piece moves, not taken at checkout. Anywhere else, regional Victoria included, is quoted rather than published, because the real cost across Victoria is several times apart from Geelong to Mildura and interstate is further again. Packed as the piece requires and sent tracked and insured. Allow longer than a parcel. Furniture and large works are sent within Australia only.

Where freight is quoted rather than priced, delivery shows as $0 at checkout. That is not free freight. It is freight we have not priced yet. You can buy the object and the $0 holds it. Within one business day we come back by email with the figure and the cover it carries, and invoice the freight then. Nothing leaves Footscray until you have agreed that figure, and if it does not work for you the order is refunded in full.

You are welcome to use your own carrier instead. Write to hello@kobk.online and we will have the piece ready to collect from Footscray. No surcharge. If you would rather have the figure before you buy at all, write to hello@kobk.online with the object and the delivery address and we will quote it first. Either way you will never be asked to pay a freight cost you have not already agreed to.

All shipments are sent with carriage insurance to the delivery point.
Delivery timeframes are estimates and not guaranteed.
Title passes to the buyer on dispatch. Risk passes to the buyer on delivery to the address you provide. If an item is damaged in transit, contact KOBK and the carrier claim is managed on your behalf.

International orders: parcels ship to the 28 countries offered at checkout, listed on the delivery check on every object page. Small parcels reach all of them. Larger or fragile objects go to New Zealand and no further. Furniture and large works are not sent overseas at all. Free postage over $150 is an Australian rule and does not apply to an overseas order. Duties, taxes and customs clearance are the responsibility of the recipient, and we cannot quote them because they are set by your country and not by us. Customs delays are not the responsibility of KOBK. Refused or abandoned international shipments will be remedied at the buyer's cost. Some objects are marked domestic only, either because of their nature or because export is restricted; these do not ship outside Australia.

6. Returns, faults, and damage in transit
Australian Consumer Law applies in full and is not excluded by these terms.

Change of mind: refunds are not offered. Each piece is one of one and sourced individually.

Quoted freight is a separate case. Where delivery showed as $0 at checkout because the freight had not been priced, and the figure we come back with is not acceptable to you, the order is cancelled and refunded in full. That is not change of mind: the freight was a term of the sale that had not been set when you paid. Say so by reply and nothing is dispatched.

Damage in transit: contact within forty-eight hours of receipt with photographs. Reporting outside this window does not exclude rights under Australian Consumer Law; it allows KOBK to act on insurance and carrier claims promptly.

Materially not as described: remedies are available under Australian Consumer Law. Patina, wear, and prior life recorded in the product page do not constitute “not as described”.

Off-catalogue acquisitions: returns beyond statutory minimums are at KOBK's discretion.

Return shipping costs are borne by the buyer except where the item is faulty or materially not as described.

7. Cultural and ethnographic material
Material from cultures and communities outside our own is held with care.
We research to the best of our ability and state what is known.
We accept that we will not always be right.
Provenance, context, or community correction is taken seriously and acted on.

KOBK acknowledges the Indigenous Cultural and Intellectual Property (ICIP) of First Peoples in Australia and equivalent rights elsewhere.
Where a community, descendant, scholar, or other rightful party can correct, contextualise, or seek return of an object, KOBK welcomes that contact and will act in good faith.
KOBK reserves the right to withdraw a listing where, in its judgement, a sale would be inappropriate.

8. Intellectual property
All text and images on this site remain the property of KOBK or the respective artist.
Use of the site is granted as a limited, personal, non-commercial license to view and purchase.
Reproduction, redistribution or commercial use requires written permission.

9. Limitation of liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Australian Consumer Law or any other applicable law that cannot be lawfully excluded.

To the extent permitted by law, KOBK's total liability arising out of any single transaction is limited, at KOBK's option, to the resupply of equivalent goods, the repair of the goods, or refund of the price paid.

KOBK is not liable for indirect, consequential, or special loss.

10. Force majeure
KOBK is not liable for delay or failure to perform caused by events beyond reasonable control, including carrier disruption, natural disaster, public health measures, or government action. Where such delay occurs, KOBK will communicate and, where required, refund or reschedule.

11. Governing law
These terms are governed by the laws of Victoria, Australia.
Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.

12. Modification
These terms may be updated from time to time. The current version is the one posted on this page. Continued use of the site after a change constitutes acceptance.

PRIVACY

This Privacy Policy describes how KOBK Pty Ltd handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Information collected
Information collected during ordering, enquiry, and direct correspondence may include: name, email address, postal and shipping addresses, telephone number, billing details, order history, and information you provide voluntarily in correspondence.

Payment card details are processed by Shopify and its payment providers and are not stored by KOBK.

2. Use of information
Personal information is used to: fulfil orders and respond to enquiries; arrange shipping and freight; communicate about a specific transaction; meet legal obligations; maintain security and integrity of the site.

Marketing communications, if offered, are sent only with consent and include an unsubscribe option in line with the Spam Act 2003 (Cth).

3. Disclosure
Personal information may be disclosed to: shipping carriers and freight partners for fulfilment; Shopify and payment processors for transaction processing; professional advisors and regulators where required by law.

Some of these recipients (including Shopify and certain payment providers) operate or store data outside Australia, including in the United States. By placing an order or providing personal information, you consent to such cross-border disclosure for the purposes stated.

4. Retention
Personal information is kept for as long as necessary to fulfil the purpose for which it was collected, plus any period required by tax, consumer protection, or other applicable law.

5. Access, correction, and complaints
You may request access to or correction of personal information KOBK holds about you by writing to hello@kobk.online.

If you believe KOBK has handled your personal information in a way that breaches the APPs, you may complain to KOBK at the same address. If the matter is not resolved, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

6. Cookies
This site uses cookies necessary for cart, checkout, and basic site functionality.
The site also uses Shopify's first-party analytics to understand how the site is used and to maintain security.
The site also uses third-party advertising and analytics tools provided through its sales channels, currently Meta (Facebook and Instagram), Google, and Pinterest. These set cookies such as _fbp, _ga, _gcl_au and _pin_unauth, and are used to measure how the site performs and to show KOBK objects to people who have visited it. You can opt out of interest-based advertising through the settings of each platform or your browser.
Visitors from regions where consent is required (including the European Union and the United Kingdom) are shown a cookie banner managed by Shopify and may withdraw or limit consent at any time.

7. Security
KOBK takes reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, and disclosure. No online transmission can be guaranteed entirely secure.

8. Children
KOBK does not knowingly collect personal information from individuals under 18.
