Use of this website, purchases made through it, and acquisitions made by direct correspondence are subject to the following.
TERMS
1. Listings and condition
Each piece is one of one.
Once sold, a listing is removed from active stock.
Objects are presented with their age intact. Patina, wear, repair history, and prior use are part of the work and are not faults.
Images, specifications and notes on the product page form part of the description.
Where attribution is verified, it is stated.
Where attribution is uncertain, possibilities are noted and the record is left open.
No warranty of attribution is given on a possibility-noted listing. Buyers should satisfy themselves before purchase and are welcome to ask.
Variations in colour, tone, grain, and texture may occur between screen and object.
Electrical items.
Where a vintage lighting item or other electrical product has been rewired or serviced by KOBK before listing, the work is carried out for domestic use, and the item is test-and-tag certified by a licensed electrician. Records are kept per item. Any modification of the item by the buyer after delivery is at the buyer's risk.
2. Availability and order acceptance
All works are subject to availability and may be withdrawn at any time before order acceptance.
A completed checkout is an offer to purchase.
Order acceptance occurs at dispatch. If a piece is sold or withdrawn before acceptance, the order is cancelled and any payment refunded in full.
3. Pricing and payment
Prices are listed in Australian Dollars (AUD).
KOBK Pty Ltd is not registered for GST at this stage. GST is not charged on orders.
Errors in pricing may be corrected before order acceptance.
Payments are processed by Shopify and its third-party providers. KOBK does not store full payment card details.
4. Off-catalogue acquisitions
Requests for pieces not currently listed may be made by email.
A written quote is required before any acquisition is binding.
No guarantee of sourcing is given. KOBK will respond with what is reasonably available.
5. Shipping
Orders are dispatched from Victoria, Australia.
Standard processing is within two business days of order acceptance for items shipping under standard service.
Some pieces cannot travel a standard channel, whether by size, fragility, or where they have to go. These are dispatched by arrangement: a freight quote is emailed within 24 hours of order placement for your approval before dispatch. By arrangement is not a premium tier. It is the most effective route for that object to that address, nothing more. Furniture and large works fall within this, and may use specialist freight.
Delivery timeframes are estimates and not guaranteed.
For furniture and large works, KOBK uses protective wrap and moving rugs in preference to single-use boxes wherever the route allows. This is stated on the product page where applicable. Where reduced packaging is used, the route and handling are arranged to keep the object safe; the protocol is part of the agreed delivery method.
All shipments are sent with carriage insurance to the delivery point.
Title passes to the buyer on dispatch. Risk passes to the buyer on delivery to the address you provide. If an item is damaged in transit, contact KOBK and the carrier claim is managed on your behalf.
International orders: duties, taxes and customs clearance are the responsibility of the recipient. Customs delays are not the responsibility of KOBK. Refused or abandoned international shipments will be remedied at the buyer's cost.
6. Returns, faults, and damage in transit
Australian Consumer Law applies in full and is not excluded by these terms.
Change of mind: refunds are not offered. Each piece is one of one and sourced individually.
Damage in transit: contact within forty-eight hours of receipt with photographs. Reporting outside this window does not exclude rights under Australian Consumer Law; it allows KOBK to act on insurance and carrier claims promptly.
Materially not as described: remedies are available under Australian Consumer Law. Patina, wear, and prior life recorded in the product page do not constitute “not as described”.
Off-catalogue acquisitions: returns beyond statutory minimums are at KOBK's discretion.
Return shipping costs are borne by the buyer except where the item is faulty or materially not as described.
7. Cultural and ethnographic material
Material from cultures and communities outside our own is held with care.
We research to the best of our ability and state what is known.
We accept that we will not always be right.
Provenance, context, or community correction is taken seriously and acted on.
KOBK acknowledges the Indigenous Cultural and Intellectual Property (ICIP) of First Peoples in Australia and equivalent rights elsewhere.
Where a community, descendant, scholar, or other rightful party can correct, contextualise, or seek return of an object, KOBK welcomes that contact and will act in good faith.
KOBK reserves the right to withdraw a listing where, in its judgement, a sale would be inappropriate.
8. Intellectual property
All text and images on this site remain the property of KOBK or the respective artist.
Use of the site is granted as a limited, personal, non-commercial license to view and purchase.
Reproduction, redistribution or commercial use requires written permission.
9. Limitation of liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Australian Consumer Law or any other applicable law that cannot be lawfully excluded.
To the extent permitted by law, KOBK's total liability arising out of any single transaction is limited, at KOBK's option, to the resupply of equivalent goods, the repair of the goods, or refund of the price paid.
KOBK is not liable for indirect, consequential, or special loss.
10. Force majeure
KOBK is not liable for delay or failure to perform caused by events beyond reasonable control, including carrier disruption, natural disaster, public health measures, or government action. Where such delay occurs, KOBK will communicate and, where required, refund or reschedule.
11. Governing law
These terms are governed by the laws of Victoria, Australia.
Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.
12. Modification
These terms may be updated from time to time. The current version is the one posted on this page. Continued use of the site after a change constitutes acceptance.
PRIVACY
This Privacy Policy describes how KOBK Pty Ltd handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1. Information collected
Information collected during ordering, enquiry, and direct correspondence may include: name, email address, postal and shipping addresses, telephone number, billing details, order history, and information you provide voluntarily in correspondence.
Payment card details are processed by Shopify and its payment providers and are not stored by KOBK.
2. Use of information
Personal information is used to: fulfil orders and respond to enquiries; arrange shipping and freight; communicate about a specific transaction; meet legal obligations; maintain security and integrity of the site.
Marketing communications, if offered, are sent only with consent and include an unsubscribe option in line with the Spam Act 2003 (Cth).
3. Disclosure
Personal information may be disclosed to: shipping carriers and freight partners for fulfilment; Shopify and payment processors for transaction processing; professional advisors and regulators where required by law.
Some of these recipients (including Shopify and certain payment providers) operate or store data outside Australia, including in the United States. By placing an order or providing personal information, you consent to such cross-border disclosure for the purposes stated.
4. Retention
Personal information is kept for as long as necessary to fulfil the purpose for which it was collected, plus any period required by tax, consumer protection, or other applicable law.
5. Access, correction, and complaints
You may request access to or correction of personal information KOBK holds about you by writing to hello@kobk.online.
If you believe KOBK has handled your personal information in a way that breaches the APPs, you may complain to KOBK at the same address. If the matter is not resolved, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
6. Cookies
This site uses cookies necessary for cart, checkout, and basic site functionality.
The site also uses Shopify's first-party analytics to understand how the site is used and to maintain security.
The site does not run third-party advertising trackers.
Visitors from regions where consent is required (including the European Union and the United Kingdom) are shown a cookie banner managed by Shopify and may withdraw or limit consent at any time.
7. Security
KOBK takes reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, and disclosure. No online transmission can be guaranteed entirely secure.
8. Children
KOBK does not knowingly collect personal information from individuals under 18.
